Forms to obtain a Mareva Injunction

This page contains all materials required to obtain a Mareva injunction and a Norwich order. These materials take many forms depending on the nature of the litigation.

Counsel have two alternatives when seeking a Mareva injunction and, optionally, a Norwich order. Counsel may either

1. prepare and issue a statement of claim, then move an urgent motion for a Mareva injunction as part of the proceeding;
2. prepare and issue a notice of application that seeks an interlocutory Mareva injunction and Norwich order as part of the relief sought.

All proceedings are by way of action unless otherwise allowed by the Rules of Civil Procedure or some other statute. An application may be filed when the facts are not likely to be controversial, or when the evidence is so clear-cut that it is unlikely that the Court will require a trial.
